Electronic Records, Signatures & Communications Consent
This Electronic Records, Signatures & Communications Consent (“E-Consent”) is provided by Union Perks Loans LLC (“Union Perks,” “we,” “us,” “our”) in connection with your use of the Cash Advance - Perks Loans App website, mobile application, and related technology and matching services (collectively, the “Services”) offered at or through unionperksloans.com and related domains (including unionperksloans.com where applicable). By clicking an “I agree,” “Continue,” “Submit,” or similarly labeled button, checking a consent box where presented, or otherwise electronically indicating your agreement, you affirm that you have read, understood, and agree to this E-Consent. If you do not agree, you should not use the electronic features of the Services that require consent and should instead contact us using non-electronic methods described in Section 10.
1. Scope of consent
You consent to receive and sign documents, disclosures, notices, authorizations, acknowledgments, adverse action notices (where applicable), account-related communications, and other records (“Communications”) in electronic form rather than solely on paper, to the extent permitted by the federal Electronic Signatures in Global and National Commerce Act (“E-SIGN Act”), 15 U.S.C. § 7001 et seq., the Uniform Electronic Transactions Act (“UETA”) as adopted in your state (including Colorado and other jurisdictions where we operate), and other applicable federal and state laws. Communications covered by this E-Consent may include, without limitation: (a) Terms of Use, Privacy Policy, and policy updates delivered electronically; (b) marketing preference confirmations and transactional messages related to the Services (subject to your separate marketing consents under the Telephone Consumer Protection Act and CAN-SPAM Act as described in our Marketing Practices page); (c) identity verification, fraud-prevention, and security alerts; (d) copies of information you submit through Cash Advance - Perks Loans App for transmission to participating lenders or vendors; and (e) any other record we are legally permitted to deliver electronically in connection with operating the Services. This list is illustrative, not exhaustive.
2. Your hardware and software requirements
To access, view, receive, retain, and print Communications in electronic form, you must maintain the following minimum requirements (which may change as technology evolves; we will update this disclosure when material changes occur):
- A device with internet access (e.g., current-version smartphone, tablet, or personal computer) capable of running a modern web browser (recent versions of Apple Safari, Google Chrome, Mozilla Firefox, or Microsoft Edge).
- A valid email address you control and routinely monitor, which you provide to us accurately and update when it changes.
- Sufficient storage space or the ability to download Communications to retain copies for your records (e.g., PDF reader, local disk, or cloud storage of your choice).

You acknowledge that failure to maintain these requirements may impair your ability to receive or retain Communications. We are not responsible for delays or failures caused by your device settings, spam filters, full mailboxes, or outdated software.
3. How we deliver electronic Communications
We may deliver Communications by posting them within the Cash Advance - Perks Loans App interface, sending them to the email address on file, presenting them in HTML or PDF format for download, using in-app messaging, or through other reasonable electronic means. Communications are deemed received when sent (for email, when transmitted to your provider’s servers absent a bounce notice) or when first made available within your authenticated session, even if you do not immediately open them. You are responsible for reviewing Communications promptly.
4. Electronic signatures
You agree that clicking buttons, typing your name in designated fields, using biometric or device-based authentication where offered, or any other method we present to capture your intent constitutes your legally binding electronic signature with the same force and effect as a handwritten signature under E-SIGN and UETA. 6. Withdrawing consent
You may withdraw your consent to receive electronic Communications that are not legally required to continue in electronic form by submitting a written request to the contact information above. Withdrawal may limit or terminate your ability to use portions of the Services that reasonably depend on electronic delivery (for example, real-time matching workflows). Withdrawal does not affect the legal effectiveness of Communications validly provided before we processed your request. Some Communications (such as certain regulatory notices) may continue by operation of law regardless of withdrawal.
7. Updating your contact information
You must promptly notify us of changes to your email address, phone number, or mailing address through account settings (if available), our contact form, or the email address above. Continued use of an outdated address does not invalidate electronic delivery if we acted in good faith on the last information you provided.
8. Records retention
We retain electronic records in accordance with our Privacy Policy, legal obligations, and legitimate business needs. Retention periods may vary by record type and jurisdiction (Delaware and others). Destruction occurs on schedules consistent with those policies unless a legal hold applies.
9. No waiver of lender-specific requirements
Participating lenders remain solely responsible for their own compliance with electronic disclosure and signature rules applicable to credit products. If a lender requires wet signatures, postal delivery, or additional hardware or software, you must satisfy those requirements separately. Nothing in this E-Consent obligates a lender to extend credit or to accept an electronic signature where prohibited by law.
